What is
Mediation?

Separation/Divorce Mediation is a voluntary negotiation process that allows separated couples to discuss their concerns related to their separation or divorce.  Participants are assisted in their discussions by a neutral third person called a mediator.  Issues that are often discussed at mediation are co-parenting, providing for the children's financial needs, and the division of property, assets, and debt.


All decisions reached in mediation are made by the participants, according to what they think is appropriate for themselves and their children.  Note that in order for you to make fair decisions, honesty and full disclosure are necessary.


Separation/Divorce mediation is an opportunity to make joint decisions concerning the financial and emotional future of your family.

What Is The Mediation Process?

Initially the mediator guides discussion in order to clarify issues and establish a common understanding of what each person wants to accomplish in mediation.  The mediator then helps participants explore possible solutions to their concerns, and helps in the writing of an agreement.  The mediator does not provide legal or financial advice.

Do I Need An Attorney?

You may find it useful to take certain questions to an attorney, financial advisor or
accountant to prepare yourself to make specific decisions. 

Are Mediated Discussions Confidential?

The court views mediation as a confidential settlement discussion.  All discussion during mediation is confidential.  By participating in mediation both parties agree that mediators, employees, volunteers, or records of the Mountain Mediation Services will not be subpoenaed by either participant or his/her attorney.

How Long Does Mediation Take?

Sessions generally last from 1-2 hours.  The number of sessions is dependant upon the number of issues needed to be discussed.  A typical case involves 2-5 sessions.
